This is a photograph or image of an item that is copyrighted in China. Chinese copyright law Section 4, Article 22 states that "a work may be exploited without permission from, and without payment of remuneration to, the copyright owner, provided that the name of the author and the title of the work shall be mentioned and the other rights enjoyed by the copyright owner by virtue of this Law shall not be prejudiced" for the purposes of: commenting on that work, for use in the media to report current events, reproduction by an "archive" for purposes of displaying or preserving a work, "copying, drawing, photographing or video recording of an artistic work located or on display in an outdoor public place" and other uses specified in the law. It is believed that using this image in Wikipedia falls under this provision of the law. The use of this photograph or image on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation, may also qualify as fair use under United States copyright law. Note: Chinese copyright law, Articles 12-14 grant copyright to creators of derivative works, providing that the copyright in the original is not infringed. The derivative copyright may require a second licensing rationale.
